County Commission and Roads

Someone at one of our meetings mentioned the role of the County Commission and roads. The following is the relevant Constitutional Article.

9-11. Powers of county commissions.

The county commissions, through their clerks, shall have the custody of all deeds and other papers presented for record in their counties, and the same shall be preserved therein, or otherwise disposed of, as now is, or may be prescribed by law. They shall also, under such regulations as may be prescribed by law, have the superintendence and administration of the internal police and fiscal affairs of their counties, including the establishment and regulation of roads, ways, bridges, public landings, ferries and mills, with authority to lay and disburse the county levies.

When I read further I found the following Amendment which I think changes Article 9-11. This was the first of many Amendments concerning roads.

Amendment 3. THE GOOD ROADS AMENDMENT OF 1920.

The Legislature shall make provision by law for a system of state roads and highways connecting at least the various county seats of the state, and to be under the control and supervision of such state officers and agencies as may be prescribed by law.

 

Based on this amendment it appears that the State has taken over most roads as prescribed by law.
